These Terms and Conditions govern your use of our online platform and participation in our outdoor social programs, wilderness therapy, community building activities, vocational training, and environmental conservation education initiatives. Participation in outdoor and mountain-based activities inherently carries certain risks, including but not limited to, those related to weather conditions, terrain, physical exertion, and wildlife. By participating in our programs, you acknowledge and accept these risks. EirePeak Programs will take all reasonable precautions to ensure safety, but cannot guarantee against all unforeseen circumstances.

It is your responsibility to ensure you are medically and physically fit to participate in the chosen program and to inform EirePeak Programs of any relevant medical conditions or allergies.

5. Booking, Payments, and Cancellations

Details regarding program bookings, applicable fees, payment methods, and cancellation policies will be provided at the time of booking. Specific terms for each program may vary and will be communicated clearly before confirmation of participation.

EirePeak Programs reserves the right to cancel or postpone programs due to insufficient numbers, adverse weather conditions, or other unforeseen circumstances. In such cases, participants will be offered alternative dates or a full refund.

All content on our online platform, including text, graphics, logos, images, and program materials, is the intellectual property of EirePeak Programs or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.

7. Limitation of Liability

To the fullest extent permitted by law, EirePeak Programs, its directors, employees, and volunteers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use our online platform or services; (ii) any conduct or content of any third party on our online platform; (iii) any content obtained from our online platform or services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

You agree to defend, indemnify, and hold harmless EirePeak Programs and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of our online platform or services, by you or any person using your account and password; b) a breach of these Terms, or c) your participation in any program.

9. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Galway, Ireland.

10. Changes to Terms

EirePeak Programs reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our online platform or services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the service.
